In any line of work, there are always a few that embarrass the rest of the profession whether you are talking about lawyers, plumbers, car salesmen, contractors, teachers, accountants, etc. Unfortunately, some of the bad apples tend to come out after injury accidents, so here is what you need to know.
After an accident, the law provides that you are not to be contacted by attorneys or chiropractors for 30 days. Before we go any further, let me go on record and say we have never nor would we ever contact an injury victim to try and get them to hire us. Through our website, blogs, commercials, speaking engagements, etc., we try to educate the public about their legal rights following an accident and, if they need legal help, we certainly hope they will call us so that we can determine the merits of their case and help them as appropriate But, we do not and will not contact injury victims unless and until they reach out to us. But some lawyers (and some chiropractors) do and it is important you keep these three things in mind:
- Some lawyers and chiropractors review the State’s police reports for auto accidents and then reach out to the person who they think was not at fault for the accident and seek to represent them.
- By law, lawyers and chiropractors must wait 30 days before soliciting an accident victim. Of course, some do not follow the rules. For example, the Tennessee Department of Health and the National Insurance Crime Bureau is investigating a Memphis chiropractic clinic for contacting accident victims sometimes within 24 hours of an accident. Even after the accident victim told the clinic they were not hurt, the chiropractic clinic would continue to solicit them. If they did get a victim to come in to the clinic, the treatment would be minimal but it is alleged they billed for much more involved treatment, which is where the insurance fraud comes in.
- You have the right to (and we urge you to) refuse the services of any chiropractor or lawyer who contacts you.
