Fundamentals Win Games and Lawsuits

Almost any coach will tell you that fundamentals win games. While lawsuits are definitely not a game, they are about winning. So just as a good baseball coach will instruct you to field a grounder with your glove on the ground and your bare hand above the glove, we want to tell you four fundamentals you can do to help win your lawsuit.

  1. Pick the right team.  Just like doctors, most lawyers specialize. And you should look for a lawyer who specializes in your type of case.   2. Listen to your coach. You hired a lawyer to help you through the legal process and it is our job to help you get a win. But, we can only do that if you take our advice to heart.
  3. Be respectful to everyone involved in the process. Listen, we know lawsuits are stressful business especially trials. (There is a reason they call it a trial). But, almost everyone responds better to civility and respect. In fact, in a recent study, researchers concluded that patients who were quarrelsome and difficult with their doctors often received worse medical care. And after more than three decades of practicing law, I can tell you jurors, judges, police officers, treating physicians, witnesses, etc. respond more favorably to a friendly disposition. If there is a need to get riled up about something, let your lawyer handle that.
  4. Don’t bend, stretch or otherwise manipulate the truth. It will almost always come back to bite you. For example, let’s say you suffer a dislocated shoulder in an accident. When the other side asks if you have ever injured your shoulder in the past, you tell them no thinking they will never find out about that time you fell and injured it 5 years before. Or you tell them no because the prior injury was fully healed and you believe it has nothing to do with the current injury.   If the prior shoulder injury from the fall was five years ago and had fully healed with no ongoing treatment, that prior shoulder injury would have not materially affected your case. But, if you get caught in a lie, untold damage will be done. Tell the truth, the whole truth and nothing but the truth – all the time.
